Manifest Website Design

These terms govern the services provided by Manifest Website Design. By engaging our services you agree to the following.

Intellectual Copyright

If your invoices aren't paid, then you don't own the artwork, website or intellectual copyright. Ownership of all work transfers to you upon full payment of all invoices.

Client Responsibilities

Clients must ensure that all content they provide — images, text, animation, video and layout — does not infringe any copyright or laws. We will flag any quality issues that may affect the final project.

Internet Marketing and Search Engine Optimisation

We build websites designed to rank well in search engines, but we make no guarantees on ranking performance. We do not promise first-page results and can refer you to one of our preferred third-party SEO providers.

Cancellation

Payments for the current billing period are non-refundable. We reserve the right to terminate a project if a client delays beyond 30 days in providing content, briefs, revisions or payment, or if the work is deemed unethical.

Quotations

The scope quoted is final. Any additional work will require an adjusted quote and may affect project timelines.

Project Delivery

Delivery schedules are estimates, not guarantees. Delays involving multiple parties may occur. Slow decision-making or feedback can really delay our production.

Exclusion of Liability

We are not responsible for any damages, lost revenue, or losses related to third parties.

Termination

Either party may terminate with 30 days' written notice. Non-payment or obstruction of work allows immediate termination. Early termination of a contract forfeits previous payments and requires covering the cost of any unpaid work completed.

Payment Methods

We accept direct bank deposit, PayPal, Stripe, Visa and MasterCard. Cheques are not accepted.

Payment of Balance

Payment terms are 7 days. Late payments obstruct project completion and our ability to pay our own bills.

Future Support

Completed websites are delivered fully functional. Ongoing support requires a separate agreement.

Grace Period

A ten-day period after completion allows for free minor edits (such as typos). Major changes will be assessed for additional charges.

Access to Client Hosting

We may require ongoing access to your hosting and domain for monitoring and support. Any password changes must be communicated to us. If we host your site, we maintain control unless agreed otherwise beforehand.

Third Party Conflicts

We cannot extend warranties to third parties. Repairs for third-party work will incur charges. Manifest Website Design is not responsible for 3rd party software failures.

Legal

We reserve the right to refuse to complete a website if it appears intended for illegitimate purposes.

Malicious Attacks

We take website security seriously, but malicious attacks are beyond our control. Repairs following an attack after completion may incur additional costs.

Compliance with Ecommerce, Accessibility, or Other Regulations

Clients must ensure their website complies with all applicable online trading laws and regulations in the relevant countries.

Compliance with Laws and Regulations

We are not responsible for accessibility, online selling, or business-specific regulatory compliance. We recommend seeking independent legal advice.
